General terms and conditions
Article 1 – Definitions
For the purposes of these Terms and Conditions, the following definitions apply:
Return Period: The period within which the consumer may exercise the right of withdrawal.
Consumer: A natural person acting for purposes outside their trade, business, or profession who enters into a distance contract with the seller.
Day: A calendar day.
Contract for a Definite Period: A distance contract providing for the regular or gradual delivery of goods and/or services over a defined period.
Durable Medium: Any medium that allows information to be stored in a way that is accessible for future reference and allows unchanged reproduction.
Right of Withdrawal: The consumer’s right to withdraw from the contract within the return period.
Entrepreneur: A natural or legal person offering goods and/or services to consumers at a distance.
Distance Contract: A contract concluded without the simultaneous physical presence of the consumer and the entrepreneur, using distance communication technology.
Distance Communication Technology: Any means used to conclude a contract without the consumer and entrepreneur being physically present at the same time.
General Terms and Conditions: These standard terms and conditions of the seller.
Article 2 – Applicability
These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, these General Terms and Conditions are made available to the consumer. If this is not reasonably possible, it will be indicated how the terms can be consulted and that they will be provided free of charge upon request.
Article 3 – The Offer
If an offer has a limited period of validity or is subject to specific conditions, this will be explicitly stated in the offer.
The offer contains a complete and accurate description of the products and/or services offered. Images, specifications, and descriptions are for illustrative purposes only and do not give rise to any right to compensation or dissolution of the agreement.
Obvious errors or mistakes in the offer do not bind the entrepreneur.
Article 4 – The Contract
The contract is concluded at the moment the consumer accepts the offer and fulfills the conditions set therein.
If the contract is concluded electronically, the entrepreneur will promptly confirm receipt of acceptance electronically. Until confirmation is received, the consumer may dissolve the contract.
The entrepreneur shall take appropriate technical and organizational measures to safeguard electronic data transmission.
Article 5 – Right of Withdrawal
When purchasing products, the consumer has the right to withdraw from the contract within 30 days without stating reasons.
The withdrawal period begins on the day following receipt of the product by the consumer.
During the withdrawal period, the consumer shall handle the product and its packaging with care and may only unpack or use it to the extent necessary to assess whether they wish to keep the product.
To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing or by email within 30 days of receiving the product. After notification, the consumer has an additional 30 days to return the product and provide proof of timely dispatch.
If the consumer fails to notify or return the product within the stated periods, the purchase becomes final.
Article 6 – Costs in Case of Withdrawal
If the consumer exercises the right of withdrawal, the costs of returning the product shall be borne by the consumer.
The entrepreneur will refund all payments received from the consumer within 5 days after receipt of the returned product or sufficient proof of return, provided the product has been returned in full.
Article 7 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for certain products or services, provided this exclusion is clearly stated in the offer prior to the conclusion of the contract.
This applies in particular to:
Customized or personalized products
Personal or hygiene-sensitive products whose packaging has been opened
Perishable goods
Products subject to price fluctuations on financial markets
Opened audio, video, or software products
Services that have commenced with the consumer’s explicit consent before the end of the withdrawal period
Bets and lotteries
Article 8 – Prices
All prices stated are valid during the period indicated in the offer, except in the event of changes in applicable taxes or legally required adjustments.
Price increases within 3 months after conclusion of the contract are only permitted if required by law. After this period, price increases are only permitted if the consumer agrees or has the right to terminate the contract.
Deliveries outside the European Union may be subject to customs duties or administrative charges imposed by local authorities or courier services.
Printing and typographical errors are not binding, and the entrepreneur is not obliged to deliver products at an incorrect price.
Article 9 – Conformity and Warranty
The entrepreneur guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, reasonable quality standards, and applicable legal requirements.
Defects must be reported in writing within 30 days of delivery.
The warranty period corresponds to the manufacturer’s warranty, where applicable. The entrepreneur is not responsible for the suitability of products for specific purposes beyond normal use.
The warranty becomes void in cases of misuse, unauthorized repairs, improper handling, or exposure to unsuitable conditions.
Article 10 – Delivery and Execution
The entrepreneur shall exercise due care in accepting and executing orders.
Delivery shall take place within 30 days, unless otherwise agreed. If delivery is delayed or incomplete, the consumer will be informed no later than 30 days after placing the order.
In such cases, the consumer has the right to terminate the contract free of charge. Any payments made will be refunded within 5 days of termination.
If delivery of an ordered product is impossible, the entrepreneur may offer a replacement product. The consumer retains the right of withdrawal for replacement items, and return costs shall be borne by the entrepreneur.
The risk of damage or loss passes to the consumer upon delivery, unless otherwise agreed.
Article 11 – Contracts for a Definite Period
Contracts for an indefinite duration may be terminated by the consumer at any time with a maximum notice period of one month.
Fixed-term contracts for the regular delivery of products or services may be terminated at the end of the agreed term with a maximum notice period of one month.
Such contracts are not automatically renewed for a fixed term, except for subscriptions to newspapers, magazines, or periodicals, which may be tacitly renewed for up to three months, provided cancellation is possible with one month’s notice.
Contracts exceeding one year may be terminated by the consumer at any time after the first year with a maximum notice period of one month, provided this is reasonable and fair.

Article 13 – Payment
Unless otherwise agreed, payment must be made within 7 working days after the start of the withdrawal period referred to in Article 5.
For services, this period begins upon confirmation of the contract.
In the event of incorrect payment details, the consumer must notify the entrepreneur without delay. In case of non-payment, the entrepreneur may charge reasonable costs permitted by law.
Article 14 – Complaints Procedure
Complaints regarding the execution of the contract must be submitted fully and clearly within 30 days after discovery of the issue.
The entrepreneur will respond to complaints within 30 days of receipt. If more time is required, the consumer will be informed accordingly.
If a complaint cannot be resolved amicably, it shall constitute a dispute subject to applicable dispute resolution procedures.
In the event of justified complaints, the entrepreneur may, at their discretion, provide a replacement or repair free of charge.
Article 15 – Governing Law
These General Terms and Conditions and all agreements arising therefrom shall be governed by and construed in accordance with the laws of Hong Kong.
